SenseDevil Terms of Service

1. Introduction

1.1. Welcome to SenseDevil, if you use SenseDevil Applications versions other than the versions distributed in specific countries/regions includes Mainland China, as used in these terms and conditions of use ("Terms"), "SenseDevil", "we", "us", or "our" refer to SenseDevil Games Limited and its relevant affiliates for the distribution of SenseDevil Applications in the corresponding countries and/or regions.

1.2. We provide our users ("SenseDevil Users") with:

  • 1.2.1 Applications for mobile, desktop platforms or devices, and web applications accessible on third-party social networking services ("SNS") (collectively, our mobile, desktop and web applications are referred to herein as "SenseDevil Applications")
  • 1.2.2 Game publisher networks, crowd sourcing services and platforms ("Networks") in connection with SenseDevil Applications and Third-Party Applications (defined below)
  • 1.2.3 Web domains and subdomains, including SenseDevilgames.com (collectively, our "Sites"), and web forums or messaging boards in SenseDevil Applications and our Sites (collectively, our "Forums")
  • 1.2.4 Any and all of our SenseDevil Applications, Networks, Sites and Forums are referred to herein as our "Services".

1.3 Please read these Terms carefully because they govern your access to and use of our Services, SenseDevil Content, and User Content (defined below) and are legally binding.

1.4 YOU ACKNOWLEDGE AND AGREE THAT, BY CLICKING ON THE "SIGN UP" BUTTON WHERE APPLICABLE, OR BY ACCESSING OR USING OUR SERVICES OR BY DOWNLOADING OR POSTING ANY CONTENT ON OR THROUGH OUR SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED AS A MEMBER (DEFINED BELOW). IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE OUR SERVICES OR SENSEDEVIL CONTENT. Certain Services, and your access to or use of certain SenseDevil Content, may have different, Service-specific or SenseDevil Content-specific terms and conditions ("Rules") posted, or may require you to agree with and accept such additional Rules. If there is a conflict between these Terms and Service-specific Rules or SenseDevil Content-specific Rules, the applicable Rules will take precedence with respect to your use of, or access to, such Service or SenseDevil Content. In addition, SenseDevil offers access to Third-Party Mobile or Desktop Applications available via our Services (each, a "Third-Party Application"), which are designed by third-party publishers (each, a "Third-Party Publisher"). You understand and agree that access to, and use of, any Third-Party Application shall be subject to terms and conditions of use were provided by the Third-Party Publisher of such Third-Party Application ("Third-Party Terms").

2. Modification

SenseDevil reserves the right, at its sole discretion, to modify, discontinue or terminate our Services, including any portion thereof, on a global or individual basis, or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post these Terms as modified or otherwise provide you with notice of the modification. By continuing to access or use our Services after we have posted a modification to these Terms or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using our Services.

3. No Unlawful or Prohibited Use

By using our Services, you represent and warrant to SenseDevil that you will not use our Services, or any of the content obtained from our Services, for any purpose that is unlawful or prohibited by these Terms.

4. Eligibility and Registration

4.1 In order to access the full feature set of our Services, and to post any User Content on or through our Services, you must register to create a SenseDevil account ("SenseDevil Account") (any SenseDevil Account, collectively, "SenseDevil Account") and become a "Member."

4.2 YOU AGREE THAT IF YOU ARE UNDER THE AGE OF 18 OR WHATEVER IS THE AGE OF LEGAL MAJORITY WHERE YOU ACCESS THE SERVICES, YOU REPRESENT THAT YOUR LEGAL GUARDIAN HAS READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

4.3 In registering for a SenseDevil Account, you agree to monitor the account to restrict any use by minors. You accept full responsibility for any unauthorized use of our Services by minors, and this includes any use of your credit cards or other payment or settlement instruments or devices by minors. During the registration process, you will be required to provide certain information, including your email address, and you will establish a username and a password. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. SenseDevil reserves the right to suspend or terminate your SenseDevil Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete.

4.4 If you are not a Member, you may only browse or use in limited ways those parts of our Services that are not limited to Members only. You are responsible for safeguarding your password. You agree not to disclose your password to any third party or to allow any third party to use your SenseDevil Account, and you agree to take sole responsibility for any activities or actions under your SenseDevil Account, whether or not you have authorized such activities or actions. You will immediately notify SenseDevil of any unauthorized use of your SenseDevil Account.

4.5 EVEN THOUGH WE USE THE WORD "YOUR" TO DESCRIBE A SENSEDEVIL ACCOUNT YOU REGISTERED FOR, YOU AGREE THAT YOU HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE SENSEDEVIL ACCOUNT AT ALL, AND YOU FURTHER AGREE THAT ALL RIGHTS IN AND TO THE SENSEDEVIL ACCOUNT ARE AND ALWAYS WILL BE OWNED BY AND INURE TO THE BENEFIT OF SENSEDEVIL.

5. Privacy

Use of our Services is also governed by SenseDevil's Privacy Policy. If you have any questions about the SenseDevil Privacy Policy, please contact us via email at: support@sensedevil.com.

6. Content

6.1 Certain types of content are made available on or through our Services:

  • 6.1.1 User Content means text, data, graphics, images, photos, video or audiovisual content, hypertext links and any other content uploaded, transmitted or submitted by a Member on or through our Services.
  • 6.1.2 SenseDevil Content means text, data, graphics, images, illustrations, forms, documents, marketing materials, look and feel attributes, SenseDevil or our licensors' trademarks and logos, SenseDevil Applications and Third-Party Applications, and other content made available by SenseDevil on or through our Services, including any Customizations but excluding User Content.
  • 6.1.3 Customizations means the modifications, designs or enhancements to SenseDevil Content as a result of a Member's or a non-registered user's customization of a SenseDevil character using one of SenseDevil's interactive templates or design tools. For the avoidance of doubt, Customizations do not include User Content.

7. Ownership

7.1 Our Services and SenseDevil Content are protected by copyright, trademark, and other laws of People's Republic of China and foreign countries.

7.2 Except as expressly provided in these Terms, SenseDevil and our licensors exclusively own all right, title and interest in and to the Services and SenseDevil Content, including all associated intellectual property rights, including any patents, copyrights, trademarks, service marks, trade names, database rights, domain name rights, applications for any of the foregoing, moral rights and trade secret rights ("Intellectual Property Rights").

7.3 SenseDevil will exclusively own all right, title and interest in and to any Customizations and you hereby waive any and all rights you may have in any Customizations under copyright law or otherwise. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying our Services or SenseDevil Content.

8. SenseDevil Content License

Subject to your compliance with these Terms, SenseDevil hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, download and print, where applicable, any SenseDevil Content solely for your personal and non-commercial purposes. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services or SenseDevil Content, except only as expressly permitted by these Terms. No licenses or rights are granted to you by implication or otherwise under any Intellectual Property Rights owned or controlled by SenseDevil or its licensors, except for the licenses and rights expressly granted by these Terms.

9. User Content

9.1 By making available any User Content on or through our Services, you hereby grant to SenseDevil a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast and otherwise exploit such User Content only on, through or by means of our Services. SenseDevil does not claim any ownership rights in any such User Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such User Content.

9.2 You acknowledge and agree that you are solely responsible for all User Content that you make available on or through our Services. Accordingly, you represent and warrant that: you either are the sole and exclusive owner of all User Content that you make available on or through our Services or you have all rights, licenses, consents and releases that are necessary to grant to SenseDevil the rights in such User Content as contemplated under these Terms; and neither the User Content nor your posting, uploading, publication, submission or transmittal of the User Content or SenseDevil's use of the User Content (or any portion thereof) on, through or by means of our Services will infringe, misappropriate or violate a third party's Intellectual Property Rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

10. No Infringing Use

You will not use our Services to offer, display, distribute, transmit, route, provide connections to or store any material that infringes copyrighted works or otherwise infringes, violates, or promotes the infringement or violation of the Intellectual Property Rights of any third party.

11. Ratings, Chat, Comments & Feedback

11.1 You can chat and make comments about content made available on or through our Services ("Comments"). SenseDevil advises you to exercise caution and good judgment when leaving such Comments. We do not generally monitor, review or moderate your Comments. Once you complete and submit your Comments on or through our Services, you should not expect to be able to go back and edit your Comments, nor should you expect us to make modifications to, or deletions of, your Comments on your behalf.

11.2 You should be aware that you could be held legally responsible for damages to someone's reputation if your Comments are deemed to be defamatory. Without limiting any other terms or conditions of these Terms, SenseDevil may, but is under no obligation to do so, monitor or censor Comments and disclaims any and all liability relating thereto. Notwithstanding the foregoing, SenseDevil does reserve the right, in its sole discretion, to remove any Comments that it deems to be improper, inappropriate or inconsistent with the online activities that are permitted under these Terms.

11.3 We welcome and encourage you to provide feedback, comments and suggestions for improvements to our Services ("Feedback"). You may submit Feedback by emailing us at service@SenseDevil.com or by submitting through our Feedback system within our Services.

11.4 You acknowledge and agree that all Feedback will be the sole and exclusive property of SenseDevil and you hereby irrevocably assign to SenseDevil and agree to irrevocably assign to SenseDevil all of your right, title, and interest in and to all Feedback, including without limitation all worldwide Intellectual Property Rights therein. Further, we are under no obligation to provide compensation for any Feedback. At SenseDevil's request and expense, you will execute documents and take such further acts as SenseDevil may reasonably request to assist SenseDevil to acquire, perfect, and maintain its Intellectual Property Rights and other legal protections in the Feedback.

12. Virtual Items and Virtual Currency

12.1 SenseDevil owns, has licensed, or otherwise has the rights to use all SenseDevil Content appearing or originating in the Services, SenseDevil Applications or Third-Party Applications, including virtual items ("Virtual Items") and virtual currency ("Virtual Currency"). Virtual Items and Virtual Currency are provided solely for your personal and entertainment use, they may only be used in SenseDevil Applications or Third-Party Applications, and they have no "real world" value. By purchasing or receiving Virtual Items and Virtual Currency all that you receive is a limited license to use them in SenseDevil Applications or Third-Party Applications by these Terms or such other terms as may apply; Virtual Items and Virtual Currency are not your personal property and no ownership interest in them is transferred to you. The prices for and the amounts and kinds of Virtual Items and Virtual Currency available may be changed at any time without notice. Virtual Items and Virtual Currency that you receive may also be changed or discontinued at any time without notice.

12.2 You cannot sell or transfer, or attempt to sell or transfer, Virtual Items or Virtual Currency, except only that where allowed you can exchange, within the Services, SenseDevil Applications, and Third-Party Applications, those Virtual Items and Virtual Currency that cannot be purchased with "real world" money ("Tradable Items") for other Tradable Items so long as no money or anything of monetary value is paid or given for Tradable Items; any other purported or attempted exchange is strictly prohibited. Virtual Items and Virtual Currency may never be redeemed by you for "real world" money, goods, wares, merchandise, services, or anything of monetary value from SenseDevil or any other person.

13. Orders & Payments

13.1 YOU AGREE THAT IF YOU ARE UNDER THE AGE OF 18 OR WHATEVER IS THE AGE OF LEGAL MAJORITY WHERE YOU ACCESS THE SERVICES, YOU MAY MAKE PAYMENTS ONLY WITH THE INVOLVEMENT OF YOUR LEGAL GUARDIAN, AND YOU REPRESENT THAT YOUR LEGAL GUARDIAN HAS READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

13.2 You may purchase, with "real world" money, limited licenses to use Virtual Items or Virtual Currency from SenseDevil in accordance with these Terms, and you agree that all such purchases are final. If you order licenses for Virtual Items or Virtual Currency from SenseDevil that become unavailable before they can be provided to you, your only remedy is to request a refund of the purchase price from the payment processor of the transaction. Your orders for limited licenses to Virtual Items or Virtual Currency are offers for use of those Virtual Items or Virtual Currency, and if accepted those Virtual Items or Virtual Currency will be immediately downloaded to your SenseDevil Account. You expressly consent to the making available of Virtual Items and Virtual Currency immediately upon acceptance of your order.

13.3 If you are a resident of the European Union and you purchase limited licenses to Virtual Items and Virtual Currency from us, the right to withdraw from such purchases within 7 working days of the date of purchase ("Cooling Off Period") may be available to you; however, this right of withdrawal will not apply where our performance begins before the end of the Cooling Off Period. Therefore, you expressly agree and understand that if you order limited licenses to Virtual Items or Virtual Currency from us, your right of withdrawal is forfeited upon acceptance as performance begins immediately on acceptance. You understand and agree that SenseDevil provides no refunds for any purchases except only as expressly stated in these Terms.

14. Taxes

You are responsible for and will pay all fees and applicable taxes incurred by you or anyone using a SenseDevil Account registered to you.

15. Mobile, Desktop Operating Software Providers and Third-Party Publishers

15.1 Providers of operating software for mobile, desktop devices ("OS Providers") offer virtual storefronts and marketplaces for you to browse, locate and download, among other things, mobile or desktop applications. If you download SenseDevil Applications or Third-Party Applications from a virtual storefront or marketplace operated by your OS Provider, please note that, in addition to complying with these Terms (and the terms and conditions of any applicable Third-Party Publisher), you must also comply with the terms and conditions of such virtual storefront or marketplace, such, as for example, Google's Android Market.

15.2 As for Third-Party Publishers, although SenseDevil is not a party to any license between you and any Third-Party Publishers with respect to Third-Party Applications, you acknowledge and agree that SenseDevil is a third-party beneficiary of each such Third-Party Application's end user license agreement. You also agree that, upon your acceptance of the terms and conditions of the license to any such Third-Party Application, SenseDevil, as a third-party beneficiary, will have the right (and will be deemed to have accepted the right) to enforce such license against you.

16. Interactions between Users

16.1 You are solely responsible for your interactions (including any disputes) with other SenseDevil Users. Even if we choose to offer report user, block user, or similar features on our Services, you will remain solely responsible for, and you must exercise caution, discretion, common sense and judgment in, using our Services and disclosing personal information to other SenseDevil Users. You agree to take reasonable precautions in all interactions with other SenseDevil Users, particularly if you decide to meet a SenseDevil User offline, or in person. Your use of our Services, SenseDevil Content, User Content and any other content made available through our Services is at your sole risk and discretion and SenseDevil hereby disclaims any and all liability to you or any third party relating thereto.

16.2 SenseDevil reserves the right to contact Members, in compliance with applicable law, in order to evaluate compliance with these Terms and any other applicable Rules. You will cooperate fully with SenseDevil to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting authorized SenseDevil representatives' access to any password-protected portions of your SenseDevil Account.

17. General Prohibitions

17.1 You agree not to do any of the following while using our Services, SenseDevil Content, or User Content:

  • 17.1.1 Post, upload, publish, submit or transmit any text, graphics, images, software, music, audio, video, information or other material that: infringes, misappropriates or violates a third party's Intellectual Property Rights, or rights of publicity or privacy;
  • 17.1.2 violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; is fraudulent, false, misleading or deceptive; is defamatory, obscene, pornographic, vulgar or offensive; promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; is violent or threatening or promotes violence or actions that are threatening to any other person; or promotes illegal or harmful activities or substances (including but not limited to activities that promote or provide instructional information regarding the manufacture or purchase of illegal weapons or illegal substances).
  • 17.1.3 Use, display, mirror, frame or utilize framing techniques to enclose our Services, or any individual element or materials within our Services, SenseDevil's name, any SenseDevil or SenseDevil licensor's trademark, logo or other proprietary information, the content of any text or the layout and design of any page or form contained on a page, without SenseDevil's express written consent;
  • 17.1.4 Access, tamper with, or use non-public areas of our Services, SenseDevil's computer systems, or the technical delivery systems of SenseDevil's providers;
  • 17.1.5 Attempt to probe, scan, or test the vulnerability of any SenseDevil system or network or breach any security or authentication measures;
  • 17.1.6 Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by SenseDevil or any of SenseDevil's providers or any other third party (including another SenseDevil User) to protect our Services or SenseDevil Content;
  • 17.1.7 Attempt to access or search our Services or SenseDevil Content, or download SenseDevil Content from our Services, through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by SenseDevil or other generally available third-party web browsers (such as Google Chrome, Microsoft Internet Explorer, Mozilla Firefox, Apple Safari or Opera);
  • 17.1.8 Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;
  • 17.1.9 Use any meta tags or other hidden text or metadata utilizing a SenseDevil or SenseDevil licensor's trademark, logo URL or product name without SenseDevil's express written consent;
  • 17.1.10 Use our Services or SenseDevil Content for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms;
  • 17.1.11 Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way our Services or SenseDevil Content to send altered, deceptive or false source-identifying information;
  • 17.1.12 Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide our Services or SenseDevil Content; Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing our Services;
  • 17.1.13 Collect or store any personally identifiable information from our Services, or from other users of our Services, without their express permission; Impersonate or misrepresent your affiliation with any person or entity;
  • 17.1.14 Violate any applicable law or regulation; Encourage or enable any other individual to do any of the foregoing;
  • 17.1.15 Post User content or take any action that infringes or violates the rights of another Member: Bully, harass or intimidate any Member of the Services; Solicit Member login credentials from another Member or collect User content or otherwise access the Services by automated means including but not limited to, bots, robots, spiders;
  • 17.1.16 Create a SenseDevil Account for anyone other than yourself;
  • 17.1.17 Use your Member profile for personal commercial gain;
  • 17.1.18 Use cheats, exploits, hacks, bots, mods or third-party software designed to gain an advantage, perceived or actual, over other Members, or modify or interfere with the Service;
  • 17.1.19 Abuse or exploit a bug, glitch or mechanism in the Service; or Engage in any fraudulent behavior, including but not limited to credit card scams or credit card misappropriation.
  • 17.1.20 Posting spam or reposting removed content in the official SenseDevil Forums. This includes but is not limited to posting the same content multiple times or reposting a thread or topic that has been removed from the forums.
  • 17.1.21 Unsportsmanlike behavior. Account sharing, including but not limited to the sharing of username and password for others to login for you.

17.2 SenseDevil will have the right to investigate and prosecute violations of any of the above, including Intellectual Property Rights infringement and Services security issues, to the fullest extent of the law. SenseDevil may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms.

17.3 You acknowledge that SenseDevil has no obligation to monitor or record your access to or use of our Services or SenseDevil Content, or to monitor, record, or edit any User Content, but agree that we have the right to do so for the purpose of operating our Services, to ensure your compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. You acknowledge and agree that you have no expectation of privacy concerning uploads, transmissions, or submissions of any User Content.

17.4 SenseDevil reserves the right, at any time and without prior notice, to remove or disable access to any User Content that SenseDevil, in its sole discretion, considers to be in violation of these Terms or otherwise harmful to our Services. We encourage SenseDevil Users to report any suspected misconduct or misuse of our Services by sending us an email to support@sensedevil.com.

18.1 Our Services may contain links to third-party websites or resources. You acknowledge and agree that SenseDevil is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by SenseDevil of such websites or resources or the content, products, or services available from such websites or resources.

18.2 You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. If you elect to use our Services on mobile, desktop carrier networks, such carrier's normal billing rates will apply. In addition, certain content, products, and services available via our Services may include materials from third parties, including Third-Party Applications.

18.3 You agree that SenseDevil is not responsible for examining or evaluating third-party content, or such content's accuracy, and SenseDevil does not warrant and will not have any liability or responsibility for any Third-Party Applications, or for any other materials, products, or services of third parties.

18.4 You agree that you will not use any Third-Party Applications, or other third-party materials, in a manner that would infringe or violate the rights of any other party, and that SenseDevil is not in any way responsible for any such use by you.

19. Sweepstakes and Contests

SenseDevil may permit the offer of sweepstakes, contests and similar promotions (collectively, "Promotions") through the Services. You should carefully review the rules (e.g., the "Official Rules") of each Promotion in which you participate through the Services, as they may contain additional important information about SenseDevil's rights to and ownership of the submissions you make as part of the Promotions and as a result of your participation in such Promotion. To the extent that the terms and conditions of such Official Rules conflict with these Terms, the terms and conditions of such Official Rules will control.

20. Termination of SenseDevil Accounts

20.1 Without limiting other remedies, SenseDevil may at any time suspend or terminate your SenseDevil Account and refuse to provide access to our Services if SenseDevil suspects or determines, in its own discretion, that you may have or there is a significant risk that you have: (i) failed to comply with any provision of these Terms or any policies or Rules established by SenseDevil; (ii) engaged in actions relating to or in the course of using our Services that may be illegal or cause liability, harm, embarrassment, harassment, abuse or disruption for you, SenseDevil Users, SenseDevil or any other third parties or our Services; or (iii) infringed the proprietary rights, rights of privacy, or Intellectual Property Rights of any person, including as a repeat infringer.

20.2 In addition, SenseDevil may notify authorities or take any other actions it deems appropriate, without notice to you, in the event of any of the above. You may terminate your SenseDevil Account at any time and for any reason by sending an email to support@sensedevil.com.

21. Effects of Termination, Suspension of Account

21.1 Upon termination of your SenseDevil Account for any reason by you or us, you will lose all access to such account. Terminated SenseDevil Accounts cannot be reinstated; any SenseDevil Account that may be registered by you after termination of a SenseDevil Account is a unique account.

21.2 If your SenseDevil Account is terminated for any reason by you or us, you understand and agree that any Virtual Items to which you had access via your SenseDevil Account at the time of termination will be lost and no longer be available to you, and you will have no right to them. If your SenseDevil Account is terminated for any reason by you or us, you understand and agree that SenseDevil may redeem and use the Virtual Currency in the SenseDevil Account at the time of termination for any purpose that it may choose, and that on termination you will have no right to that Virtual Currency. In addition, if there is no activity in your SenseDevil Account for 3 years (Inactive Account), you understand and agree that (i) SenseDevil may redeem and use the Virtual Currency in the Inactive Account at such time for any purpose that it may choose, and that on the account becoming an Inactive Account you will have no right to that Virtual Currency; and (ii) any Virtual Items to which you had access via the Inactive Account up to the account becoming an Inactive Account will be lost and no longer be available to you, and you will have no right to them.

21.3 YOU AGREE THAT SENSEDEVIL IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS OR VIRTUAL CURRENCY IN AN INACTIVE ACCOUNT OR THAT WAS IN A TERMINATED SENSEDEVIL ACCOUNT, NO MATTER HOW EITHER CAME ABOUT. After any termination, you understand and acknowledge that we will have no further obligation to provide our Services and all licenses and other rights granted to you by these Terms will immediately cease. SenseDevil will not be liable to you or any third party for termination of our Services or termination of your use of our Services.

21.4 UPON ANY TERMINATION OR SUSPENSION OF YOUR SENSEDEVIL ACCOUNT, ANY CONTENT, MATERIALS OR INFORMATION (INCLUDING USER CONTENT) THAT YOU HAVE SUBMITTED ON OUR SERVICES OR THAT WHICH IS RELATED TO YOUR SENSEDEVIL ACCOUNT MAY NO LONGER BE ACCESSED BY YOU. Furthermore, SenseDevil will have no obligation to maintain any information stored in our database related to your SenseDevil Account or to forward any information to you or any third party. Any suspension, termination or cancellation will not affect your obligations to SenseDevil under these Terms (including, without limitation, proprietary rights and ownership, indemnification and limitation of liability), which by their sense and context are intended to survive such suspension, termination or cancellation.

22. Disclaimers

OUR SERVICES, SENSEDEVIL CONTENT, AND USER CONTENT ARE PROVIDED AS IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, SENSEDEVIL EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. SENSEDEVIL MAKES NO WARRANTY THAT OUR SERVICES, SENSEDEVIL CONTENT OR USER CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. SENSEDEVIL MAKES NO WARRANTY REGARDING THE QUALITY OF ANY PRODUCTS, SERVICES OR CONTENT PURCHASED OR OBTAINED THROUGH OUR SERVICES OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH OUR SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SENSEDEVIL OR THROUGH OUR SERVICES, SENSEDEVIL CONTENT OR USER CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

23. Indemnity

You agree to defend, indemnify, and hold SenseDevil, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with User Content you submit to SenseDevil, your access to our Services or SenseDevil Content, or your violation of these Terms.

24. Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF OUR SERVICES, SENSEDEVIL CONTENT, AND USER CONTENT THEREIN REMAINS WITH YOU. NEITHER SENSEDEVIL NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING OUR SERVICES OR SENSEDEVIL CONTENT WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE OUR SERVICES OR CONTENT THEREIN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SENSEDEVIL HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. YOU SPECIFICALLY ACKNOWLEDGE THAT SENSEDEVIL IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU. FURTHER, SENSEDEVIL WILL HAVE NO LIABILITY TO YOU OR TO ANY THIRD PARTY FOR ANY USER CONTENT OR THIRD-PARTY CONTENT UPLOADED ONTO OR DOWNLOADED FROM OR THROUGH OUR SERVICES. IN NO EVENT WILL SENSEDEVIL'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE OUR SERVICES OR SENSEDEVIL CONTENT OR USER CONTENT THEREIN OR PROVIDED THEREBY EXCEED ONE HUNDRED U.S. DOLLARS ($100). THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN SENSEDEVIL AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

25. Trademarks & Other Proprietary Rights Notices

All trademarks, service marks, logos, trade names and any other proprietary designations of SenseDevil or our licensors used in association with the Services are trademarks or registered trademarks of SenseDevil or our licensors. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of the respective owners of same.

26. Controlling Law and Jurisdiction

These Terms and any action related thereto will be governed by the laws of People's Republic of China without regard to its conflict of law's provisions. Any dispute arising from or in connection with These Terms shall be submitted to Shanghai International Economic and Trade Arbitration Commission/Shanghai International Arbitration Center ("SHIAC") for arbitration, which shall be conducted in accordance with SHIAC's arbitration rules in effect at the time of applying for arbitration. The seat of arbitration shall be Shanghai, China. The language to be used in the arbitral proceedings shall be Chinese. The arbitral award is final and binding upon both parties.

27. Entire Agreement

These Terms constitute the entire and exclusive understanding and agreement between SenseDevil and you regarding our Services and SenseDevil Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between SenseDevil and you regarding our Services and SenseDevil Content.

28. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without SenseDevil's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. SenseDevil may freely assign these Terms. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

29. Notices

29.1 You consent to the use of: (i) electronic means to complete these Terms and to deliver any notices or other communications permitted or required hereunder; and (ii) electronic records to store information related to these Terms or your use of our Services.

29.2 Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, will be in writing and given: (i) by SenseDevil via email (in each case to the address that you provide) or (ii) by posting on or through our Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

30. General

30.1 The failure of SenseDevil to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SenseDevil.

30.2 Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise. If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.

30.3 You agree that (i) these Terms are intended to cover any Third-Party Publisher who is an affiliate of SenseDevil Technology Hong Kong Limited ("Affiliate Publisher"); (ii) your obligations to SenseDevil under these Terms extend to Affiliate Publishers as applicable unless otherwise agreed under any Third-Party Terms with any such Affiliate Publisher; and (iii) Affiliate Publishers are third party beneficiaries under these Terms who may rely on and directly enforce these Terms against you as such.

《恶龙游戏许可及服务协议》（以下简称"本协议"）由用户与服务提供方重庆森魔科技有限公司（以下简称森魔科技）共同缔结，本协议具有合同效力。"恶龙"是本公司的注册商标及品牌。本协议仅适用于由重庆森魔科技有限公司在中国大陆地区，面向中国大陆用户发行的游戏产品及提供的服务。如用户使用"恶龙游戏"品牌旗下在其他地区发行的游戏产品及提供的服务，相关服务将由森魔科技的合作方或其他第三方提供，请至对应游戏产品及服务的下载页面（如游戏产品官网、App Store或Google Play商店页面等）查看相应服务条款。

请用户务必审慎阅读、充分理解各条款内容，特别是免除或者限制责任的条款，以及开通或使用某项服务的单独协议。除非用户已阅读并接受本协议所有条款，否则用户无权使用恶龙游戏及服务。用户注册、登录、使用恶龙游戏及服务即视为用户已阅读并同意签署本协议。如果用户未满18周岁，请在法定监护人的陪同下阅读本协议，并特别注意未成年人使用条款。

重要须知：

第一、用户在使用恶龙游戏及相关各项服务之前，请仔细阅读本协议中各项条款。森魔科技在此特别提醒用户认真阅读本协议的全部条款，特别是其中免除或者限制森魔科技责任的条款（该等条款通常含有"不负任何责任"、"无义务"等词汇）和其它限制用户权利的条款（该等条款通常含有"不得"等词汇），这些条款应在中国法律所允许的范围内最大程度地适用。

第二、如用户不同意本协议的条款，请不要安装、注册、登录、使用恶龙游戏或者相关服务。用户一旦点击"接受"、"同意"或其他类似含义的按键并安装恶龙游戏，或者注册、登录、开始使用及/或继续使用恶龙游戏或相关服务，即视为用户已经接受本协议中全部条款。此后您不得以未阅读本协议内容或类似理由提出任何形式的抗辩。

第三、用户有权在使用恶龙游戏及相关服务的期间，监督森魔科技及森魔科技的工作人员是否按照森魔科技所公布的标准向用户提供服务，也可以随时向森魔科技提出与森魔科技的产品和服务有关意见和建议。

1、定义和说明

本协议中，如无相反说明，以下词语具有如下含义：

1.1 本协议：指本协议正文、《恶龙游戏隐私条款》、业务规则及其修订版本。上述内容一经正式发布，即为本协议不可分割的组成部分。

1.2 森魔科技：又称"恶龙"或"恶龙游戏"，指恶龙游戏产品或服务的提供者，详见本协议第6.1条。

1.3 业务规则：指恶龙游戏服务提供方不时发布并修订的关于恶龙游戏的用户守则、针对特定恶龙服务或产品的协议条款、玩家条例、游戏公告、活动规则及通知等内容。

1.4 恶龙游戏：指由森魔科技负责运营的移动端游戏的统称（包括但不限于：该移动端游戏的Android版、iOS版等任何可在移动智能设备上操作的适配版本），以及与该等移动端游戏相关的更新、升级、补丁、资料片等；恶龙游戏可能以软件形式提供，这种情况下，恶龙游戏还包括该相关软件及相关文档。

1.5 用户：又称"最终用户"、"您"，指通过森魔科技提供的合法途径获得恶龙游戏使用许可而安装、使用恶龙游戏及服务的自然人。

1.6 游戏账号：又称"账号"、"用户账号"，指用户为使用恶龙游戏服务，依照本协议及相关法规政策规定成功注册的用户账号。

1.7 恶龙大会员：又称"会员"、"VIP"，指通过使用恶龙游戏服务（在恶龙游戏内或恶龙官网注册账号并绑定手机号）获得会员资格的用户，会员可通过一定方式获得会员经验，并享有会员经验对应的会员等级及福利（如有）。会员账号与游戏账号为一一对应关系，会员享有福利的游戏产品及福利内容以恶龙实际发放为准。

1.8 恶龙游戏服务：又称"恶龙服务"，指恶龙及其关联公司或其授权的合作方向用户提供的与游戏相关的各项服务，包括但不限于游戏运营服务、游戏推广服务、充值服务等。

1.9 游戏数据：指用户在使用恶龙游戏过程中产生的被服务器记录的各种数据，包括游戏日志、安全日志等数据。

2、知识产权声明

2.1 森魔科技依法享有恶龙游戏的一切合法权属（包括但不限于知识产权）。恶龙游戏的全部著作权等知识产权及其他合法权益，以及与恶龙游戏相关的所有信息内容，包括但不限于：文字表述及其组合、图标、图饰、图表、色彩组合、界面设计、版面框架、有关数据、印刷材料、或电子文档等，均受中国知识产权相关法律法规和相应的国际条约的保护。

2.2 恶龙游戏所体现的"森魔科技、产品徽标（图形）和/或森魔科技的产品和服务标示"均属于森魔科技在中国及/或其他国家/地区的商标或者注册商标。用户未经合法授权不得自行使用。

2.3 森魔科技在涉及恶龙游戏及相关服务中拥有专利权、专利申请权、商标权、著作权等知识产权及其他合法权益。森魔科技并未因为本协议或者因为向用户提供恶龙游戏以及相关服务而授予用户任何与恶龙游戏相关的知识产权。本协议未明确授予用户的权利均由森魔科技保留。

3、游戏账号

3.1 用户如果需要使用和享受恶龙游戏及其相关服务，则用户需要按照相关法律法规及政府监管部门的要求，登录实名注册系统并进行实名注册、验证。

3.2 用户充分理解并同意，恶龙会按照国家相关要求将用户的实名注册信息运用于防沉迷系统之中，即恶龙可能会根据用户的实名注册信息判断用户是否年满18周岁，从而决定是否对用户的游戏账号予以防沉迷时间限制及充值限制。

3.3 用户充分理解并同意，为更好地向用户提供恶龙游戏服务，用户同意并授权恶龙为履行本协议而收集用户的个人信息。在用户使用恶龙游戏服务过程中，恶龙将根据本协议和《恶龙游戏隐私条款》规定的方式收集用户主动提供的或者因使用服务而产生的信息，恶龙可以将用户的信息提交给其关联公司，且恶龙有权自行或通过第三方对用户信息进行整理、统计、分析及利用，具体可查看《恶龙游戏隐私条款》。

3.4 用户充分理解并同意，恶龙或其合作的第三方可以根据用户信息，通过短信、电话、邮件等各种方式向用户推送关于恶龙游戏的活动信息、推广信息等各类信息，具体使用内容及使用方式可查看《恶龙游戏隐私条款》。

4、隐私政策

尊重用户个人隐私是森魔科技的一项基本政策，所以，森魔科技不会公开、修改或透露用户的信息及保存在森魔科技各项服务中的非公开内容，除非森魔科技在诚信的基础上认为透露这些信息是必要的，或按照《恶龙游戏隐私条款》之约定或其他途径获得用户事先同意，包括但不限于以下情形：

4.1 遵守有关法律法规规定，包括在国家有关机关查询时，提供用户在森魔科技的网页上发布的信息内容及其发布时间、互联网地址或者域名。

4.2 保持维护森魔科技的知识产权和其他重要权利。

4.3 在紧急情况下竭力维护用户个人和社会大众的隐私安全。

5、责任限制

5.1 用户承诺自行承担因使用恶龙游戏及相关服务所引起的任何风险。除根据特定目的和不违反规定的明确的适当的担保以外，森魔科技不作其他任何类型的担保（不论是明确的或隐含的）。森魔科技不担保：

5.1.1 恶龙游戏及森魔科技提供的相关服务符合用户的要求；

5.1.2 恶龙游戏及森魔科技提供的相关服务不受不可抗力、计算机病毒、黑客攻击、系统不稳定、用户所在位置、用户关机、电信部门原因及其他任何网络、技术、通信线路等外界或人为因素的影响；

5.1.3 安装、复制、访问网站、充值、运行恶龙游戏或以其它方式使用恶龙游戏及/或接受森魔科技提供的相关服务与任何其他软件不存在任何冲突；

5.1.4 通过森魔科技网站、游戏官方网站及其他相关网络上的链接和标签所指向的第三方的商业信誉及其提供服务的真实性、有效性和合法性。用户在使用恶龙服务的过程中可能跳转至森魔科技合作方的网站、app或其他由第三方提供的服务内容（包括但不限于微信、支付宝、云闪付等支付渠道），该等服务内容由第三方独立提供，如因使用的第三方软件或技术引发的任何纠纷，应由该第三方负责解决，森魔科技不承担任何责任。森魔科技不对第三方软件或技术提供客服支持，若您需要获取支持，请与该第三方联系。

5.2 用户充分理解并同意，为提高恶龙游戏服务的安全水平，恶龙有权将有关技术或软件应用到恶龙游戏中，但恶龙不保证这些安全保障措施可以完全杜绝游戏账号被他人窃取或丢失的风险。

5.3 用户充分理解并同意，为高效利用服务器资源，如果用户连续365天未登录游戏，恶龙有权在提前通知的前提下，对该账号及其账号下的游戏数据及相关信息（包括但不限于角色、等级、虚拟物品、虚拟货币等数据信息）采取删除等处置措施，上述处置可能导致用户对该游戏账号下相关权益的丧失，删除后的数据信息无法再恢复，对此恶龙不承担任何责任。

5.4 若账号存在异常（包括但不限于用户账号或游戏数据的游戏角色、游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币及会员经验、会员积分等账号数据出现异常），在账号异常的原因未查明前，恶龙有权暂时冻结您的账号；若账号异常为非正常游戏行为所致，恶龙有权采取相应的措施，包括但不限于恢复游戏账号数据至异常发生前的原始状态（包括但不限于向第三方追回被转移数据，扣除游戏礼包内容或相等价值的虚拟货币及虚拟道具、账户内代金券、优惠券、游戏道具、游戏装备、游戏币，扣除会员经验或会员积分，降低会员等级等），倒扣数值，取消会员资格，限制账号功能、删除游戏账号或其他恶龙认为合理的措施，且恶龙无须向您承担任何责任。前述账号异常包括但不限于以下情况：

5.4.1 因游戏软件BUG、版本更新缺陷、第三方病毒攻击或其他任何因素发生异常；

5.4.2 因第三方交易、账号使用人与实名认证信息不符等导致账号异常或权属存在争议；

5.4.3 利用非法手段或通过其他未经恶龙授权的第三方充值导致账号异常；

5.4.4 账号存在恶意退款情形，前述恶意退款包括但不限于用户通过充值获得游戏礼包、代金券、游戏内道具、资源、装备等增值服务（简称"账号资源"）后，自行进行退款操作而未通过恶龙官方公布的客服联系方式通知恶龙扣除相应账号资源或上述账号资源已消耗、转移或存在其他客观上无法扣除的情况仍自行进行退款操作；

5.4.5 账号存在本协议第7.5条及7.6条约定的违规情形；

5.4.6 账号存在违反本协议的其他情形。

5.5 恶龙未授权用户从任何第三方通过购买、接受赠与或者其他的方式获得游戏账号、游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币、会员经验、会员积分及等级等其他增值服务，恶龙不对第三方交易的行为负责，并且不受理因任何第三方交易发生纠纷而带来的申诉。

5.6 用户充分理解并同意，不同操作系统之间可能存在不互通的客观情况，该客观情况并非恶龙造成，由此可能导致用户在某一操作系统中的充值和游戏数据不能顺利转移到另一操作系统中。由于用户在不同操作系统进行切换造成的充值损失和游戏数据丢失风险应由用户自行承担，恶龙不承担任何责任。

5.7 用户充分理解并同意，恶龙游戏中可能会设置强制对战区域或玩法，如果用户不同意强制对战，请用户不要进入该游戏或游戏区域；用户的进入，将被视为同意该玩法并接受相应后果。

5.8 用户充分理解并同意：

5.8.1 森魔科技向用户提供虚拟增值服务本身属于商业行为，用户有权自主决定是否根据森魔科技、其关联公司或授权的合作方提供的收费项目（包括但不限于购买游戏礼包、代金券、优惠券、获得游戏内的游戏虚拟道具的使用权、接受其他增值服务等各类收费项目）及收费标准支付相应的费用，以获得相应的虚拟增值服务。如用户不按相应标准支付相应费用的，用户将无法获得相应的恶龙服务。

5.8.2 用户知悉并同意，收费项目或收费标准的改变、调整是一种正常的商业行为，用户不得因为收费项目或收费标准的改变、调整而要求森魔科技或其关联公司进行赔偿或补偿。

5.8.3 用户使用法定货币通过恶龙游戏或恶龙服务进行礼包购买、代金券购买、使用优惠券、兑换游戏虚拟道具或其他增值服务的，您所购买或兑换的游戏虚拟道具、礼包、代金券或其他增值服务将不能退还或兑换成法定货币，但法律另有强制性规定的除外。

5.8.4 如果游戏内或宣传中未对游戏虚拟物品、虚拟增值服务等内容的有效期限进行标明或将有效期限标明为"永久"及其他与"永久"相似含义的表述（例如"长期""无限制""无限期"等），则其有效期限为自用户获得该游戏游戏虚拟物品或虚拟增值服务起至该游戏终止运营之日止；如对有效期限有特殊标注的（如"30日"），则其有效期限以标注为准（该期限为自然日，起算后不因任何原因而中止或中断），恶龙将在有效期限结束时收回该物品使用权或停止该服务而不另行通知用户。

6、软件、服务与协议的变更、终止

6.1 恶龙游戏及相关服务的具体内容由森魔科技根据实际提供。

6.2 为了保障公司业务发展，森魔科技拥有变更恶龙游戏（包括但不限于升级、更新、增加、减少、演绎，等）及相关服务以及本协议内容的权利，也拥有终止恶龙游戏/相关服务/本协议的权利；如有必要，森魔科技会以公告等形式公布于恶龙游戏网站重要页面上。森魔科技提请用户定期查阅了解有关变更、终止等信息。

6.3 用户拥有自主权利，单方面随时决定终止使用恶龙游戏及相关服务并卸载恶龙游戏。如森魔科技对恶龙游戏、相关服务或本协议的内容作出任何变更，而用户不同意有关变更的内容，用户有权单方面立即停止使用恶龙游戏以及相关服务并卸载恶龙游戏。如用户在有关内容变更后，仍继续使用恶龙游戏和相关服务，即视为用户同意接受有关变更内容。

7、权利和义务

7.1 在用户遵守本协议及相关法律法规的前提下，恶龙授予用户一项个人的、不可转让及非排他性的许可，以使用恶龙游戏服务。用户仅可为非商业目的使用恶龙游戏服务，包括：

7.1.1 接收、下载、安装、启动、升级、登录、显示、运行和/或截屏恶龙游戏；

7.1.2 创建游戏账号、游戏角色，设置名称，查阅业务规则、用户个人资料、游戏对局结果，开设游戏房间、设置游戏参数，在游戏中或通过恶龙服务领取、购买、使用游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币等，使用聊天功能、社交分享功能；

7.1.3 使用恶龙游戏支持并允许的其他某一项或几项功能。

7.2 用户充分理解并同意：游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币等是恶龙游戏服务的一部分，恶龙在此许可您依本协议而获得其使用权。用户领取、购买、使用游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币等应遵循本协议、业务规则的要求；同时，游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币、会员经验、会员积分及等级福利等可能受到一定有效期限的限制，若用户在规定的有效期内未使用，除不可抗力或可归责于恶龙的原因外，一旦有效期届满，将会自动失效。

7.3 用户充分理解并同意：为营造公平、健康的游戏环境，在用户使用恶龙游戏服务的过程中，在不违反相关法律规定情况下，恶龙有权通过技术手段了解用户终端设备的随机存储内存以及与恶龙游戏同时运行的相关程序。一经发现有任何未经授权的、危害恶龙游戏服务正常运营的相关程序，恶龙将收集所有与此有关的信息并采取合理措施予以打击。

7.4 恶龙将按照相关法律法规和本协议的规定，采取切实有效的措施保护未成年人在使用恶龙游戏服务过程中的合法权益，包括可能采取技术措施、禁止未成年人接触不适宜的游戏或者游戏功能、限制未成年人的游戏时间、预防未成年人沉迷网络。作为业务规则的一部分，恶龙还将在适当位置发布恶龙游戏用户指引和警示说明，包括游戏内容介绍、正确使用游戏的方法以及防止危害发生的方法。所有未成年人用户均应在法定监护人的指导下仔细阅读并遵照执行这些指引和说明；所有用户在使用恶龙游戏服务的过程中应避免发布、产生任何有损未成年人身心健康的内容，共同营造健康游戏环境。

7.5 用户理解并同意，在下列任一情形下，恶龙有权将用户的游戏账号纳入相应的防沉迷系统，采取相应的防沉迷措施：

（1）系统判断您为未成年人；或

（2）您提交的实名身份信息不规范的；或

（3）您实名验证未通过的；或

（4）恶龙有合理理由认为需要纳入防沉迷系统的；或

（5）其他国家法律法规政策要求的情形的。

对纳入相应防沉迷系统的游戏账号，我们有权依据国家有关法律法规及政策规定、本协议、其他相关业务规则的规定采取以下一种或多种措施：

（1）将与您游戏相关的信息（包括但不限于您游戏账号的登录信息等）提供给您的法定监护人，使得您法定监护人可及时或同步了解您游戏情况；

（2）限制您游戏账号的消费额度；

（3）限定您游戏时间或游戏时长；

（4）恶龙认为可采取的其他合理措施，以限制或禁止您使用恶龙游戏；

（5）国家法律法规或政策要求的相关措施。

用户不得通过第三方购买、接受赠与或者其他方式企图绕开恶龙对于未成年人在游戏虚拟道具及其他游戏增值服务（包括充值方面、消费额度、游戏时间等）的限制，否则因此产生的任何纠纷或申诉，森魔科技有权不予受理。

7.6 除非本协议另有规定，否则，未经森魔科技书面同意，用户不得实施下列行为（无论是营利的还是非营利的）：

7.6.1 复制、翻拷、传播和陈列恶龙游戏的程序、使用手册和其它图文音像资料的全部或部分内容。

7.6.2 公开展示和播放本产品的全部或部分内容。

7.6.3 出租、销售恶龙游戏或者利用恶龙游戏从事营利行为。

7.6.4 修改或遮盖恶龙游戏程序、图像、动画、包装和手册等内容上的产品名称、公司标志、版权信息等内容。

7.6.5 其它违反著作权法、计算机软件保护条例和相关法律法规的行为。

7.7 用户应通过合法的途径使用恶龙游戏和相关服务，不得作出以下侵害森魔科技或第三人利益，扰乱游戏秩序，违反游戏公平性、违反本协议或者森魔科技发布的其他业务规则或者有关法律法规规定的行为，包括但不限于：

7.7.1 修改、翻译、注释、整理、汇编、演绎恶龙游戏；

7.7.2 反向工程、反向编译或者反汇编恶龙游戏，或者采用其他技术手段对恶龙游戏进行分析、修改、攻击、衍生；

7.7.3 使用任何外挂程序或游戏修改程序（本协议所称"外挂程序"是指独立于游戏软件之外的，能够在游戏运行的同时影响游戏操作的所有程序，包括但不限于模拟用户操作、改变操作环境、修改数据等一切类型。如有关法律、法规及政府主管部门的规章或规范性文件规定的外挂定义与本协议有冲突，则以法律、法规、部门规章或规范性文件规定的为准），对恶龙游戏或服务进行还原工程、编译、译码或修改，包括但不限于修改恶龙游戏所使用的任何专有通讯协议、对动态随机存取内存（RAM）中资料进行修改或锁定；

7.7.4 使用异常的方法登录游戏（包括但不限于使用非森魔科技开发、授权或认可的第三方软件、系统登录游戏）、使用网络加速器等外挂软件或机器人程式等恶意破坏恶龙游戏或服务的设施、扰乱正常服务秩序的行为；

7.7.5 通过异常或者非法方式使用恶龙游戏或服务（包括但不限于使用未经恶龙同意对恶龙游戏或服务进行修改、衍生、反向工程、破解而形成的私服、破解版本及其他内容），恶意破环恶龙游戏，扰乱正常的服务秩序或者实施其他不正当行为；

7.7.6 制作、传播或使用外挂、封包、加速软件及其它各种作弊程序，或组织、教唆他人使用此类软件程序，或销售此类软件程序而为个人或组织谋取经济利益；

7.7.7 使用任何方式或方法，试图攻击提供游戏服务的相关服务器、路由器、交换机以及其他设备，以达到非法获得或修改未经授权的数据资料、影响正常游戏服务，以及其他危害性目的的任何行为；

7.7.8 利用恶龙游戏或者线上游戏系统可能存在的技术缺陷或漏洞而以各种形式为自己及他人牟利（包括但不限于复制游戏中的虚拟物品等）或者从事其他不正当行为；

7.7.9 违反国家有关法律法规的规定，利用恶龙游戏制作、复制、发布和传播信息或者从事违法违规行为。特别地，不得制作、复制、发布和传播下列内容：

（1）反对宪法所确定的基本原则的；

（2）危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；

（3）损害国家荣誉和利益的；

（4）歪曲、丑化、亵渎、否定英雄烈士事迹和精神，以侮辱、诽谤或者其他方式侵害英雄烈士的姓名、肖像、名誉、荣誉的；

（5）煽动民族仇恨、民族歧视，破坏民族团结的；

（6）破坏国家宗教政策，宣扬邪教和封建迷信的；

（7）散布谣言，扰乱社会秩序，破坏社会稳定的；

（8）散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；

（9）侮辱或者诽谤他人，侵害他人合法权益的；

（10）发布任何经恶龙合理判断为不妥当或者恶龙未认可的软件、文件等在内的主页地址或者链接的；

（11）违背社会公序良俗的；

（12）含有中华人民共和国法律、行政法规禁止的其他内容的。

7.7.10 以某种方式暗示或伪称恶龙内部员工或某种特殊身份，企图得到不正当利益或影响其他用户权益的行为；

7.7.11 在恶龙游戏中使用非法或不当词语、字符等，包括用于角色命名；

7.7.12 盗取他人游戏账号、游戏物品；

7.7.13 私自进行游戏账号、游戏礼包、代金券、优惠券、游戏道具、游戏装备、游戏币等交易；

7.7.14 其他在行业内被广泛认可的不当行为，无论是否已经被本协议或业务规则明确列明。

一旦森魔科技通过内部的监测程序发现或经其他用户举报而发现用户有可能正在从事上述行为，则森魔科技有权作出独立的判断并采取相应的措施，该措施包括但不限于限制用户账号的登录、限制用户在游戏中的活动、终止恶龙游戏授权、删除与复制有关的物品（包括复制出的虚拟物品和参与复制的虚拟物品）、删除用户的账号并要求用户赔偿因从事上述行为而给森魔科技造成的损失等。

7.8 森魔科技提供可使用的恶龙游戏及其相关服务，并运用自己的网络系统通过国际互联网络（Internet）为用户提供相应的服务。同时，用户应自行提供以下的设备和信息：

7.8.1 自行配备上网的所需设备，包括移动设备（包括但不限于移动电话、平板电脑）、无限路由器或其他必备上网装置；

7.8.2 自行负担个人上网所支付的与此服务有关的电话费用、网络费用；

7.8.3 基于森魔科技提供服务的重要性，用户同意：

（1）提供详尽、真实、准确、完整、合法的个人资料及其他相关信息。

（2）不断更新注册资料，符合及时、详尽、真实、准确、完整、合法的要求。

（3）牢记用户填写的注册资料、历史信息。

森魔科技在为用户提供相关客户服务的前提是用户能表明用户是账号的所有人，这可能需要用户提供相关信息（包括但不限于注册信息、实名身份信息、历史密码等）。用户理解并同意，如果用户无法提供准确完整的注册资料及相关历史信息、未及时更新相关注册资料或者相关的证据，将有可能导致森魔科技无法判断用户的身份，从而无法为提供密码找回等相关服务，而森魔科技对此不承担任何责任。如因用户提交的相关信息资料不真实、不准确、不完整、不合法从而导致森魔科技作出错误的判断的，森魔科技有权终止为用户提供服务并追究用户的法律责任。

7.9 森魔科技保留通过恶龙游戏和相关的服务向用户投放商业性广告的权利。

8、违约责任

8.1 用户同意保障和维护森魔科技及其他用户的利益，如因用户违反有关法律、法规或本协议项下的任何条款而给森魔科技造成损害，用户同意承担由此造成的损害赔偿责任，该等责任包括但不限于给森魔科技造成的任何直接或间接损失。

8.2 如用户违反本协议、森魔科技发布的其他规则或者国家法律法规规定，则森魔科技有权作出独立的判断，立即撤销相关许可，终止为用户提供服务并通过各种合法途径追究用户的法律责任。

9、法律适用和争议解决

9.1 本协议由用户与森魔科技签订于重庆市渝中区。

9.2 本协议的订立、履行、解释及争议的解决均应适用中华人民共和国法律并排除其他一切冲突法的适用。

9.3 如双方就本协议内容或其执行发生任何争议，双方应尽量友好协商解决；协商不成时，任何一方均应向重庆市渝中区人民法院提起诉讼。

10、其他规定

10.1 本协议构成双方对本协议之约定事项及其他有关事宜的完整协议，除本协议规定的之外，未赋予本协议各方其他权利。

10.2 如本协议中的任何条款因任何原因被判定为完全或部分无效或不具有执行力的，该无效或不具有执行力的条款将被最接近原条款意图的一项有效并可执行的条款所替代，并且本协议的其余条款仍应有效并且有执行力。

10.3 森魔科技不行使、未能及时行使或者未充分行使本协议或者按照法律规定所享有的权利，不应被视为放弃该权利，也不影响森魔科技在将来行使该权利。
